Clear Energy Services ("we", "us", "our") is committed to protecting your privacy. This policy explains what personal information we collect, how we use it, and the rights you have over it. We handle your data in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Who we are

Clear Energy Services is an ECMK-accredited Domestic Energy Assessor providing Energy Performance Certificates (EPCs) and Retrofit Assessments across Greater Manchester. We are the data controller for the information described in this policy.

Information we collect

We only collect information that we need in order to quote for and carry out our services. This may include:

• Your name, email address and telephone number
• The address and postcode of the property to be assessed
• Details about the property, such as type, size, age, heating system and any improvements
• Photographs and measurements taken during a survey, used solely to produce your certificate
• Any additional information you choose to give us in an enquiry or message

How we collect it

We collect information when you complete the enquiry form on our website, submit a lead form through an online advertisement, call or text us, message us on WhatsApp, email us, or speak with us during a survey.

How we use your information

• To respond to your enquiry and provide a quotation
• To arrange and carry out an EPC or Retrofit Assessment
• To produce your certificate or report and send it to you
• To lodge your certificate on the national EPC register, as we are legally required to do
• To keep records required by our accreditation scheme
• To invoice you and keep accounting records
• To contact you about your booking or certificate

Our lawful basis for processing

We rely on the following lawful bases under UK GDPR:

• Contract — to provide the service you have asked us for
• Legal obligation — to lodge certificates on the national register and to keep records required by law and by our accreditation scheme
• Legitimate interests — to respond to enquiries and to run our business, balanced against your rights

Who we share it with

We do not sell your personal information to anyone. We share it only where necessary:

• The national EPC register, operated on behalf of the UK Government. Certain property details and your certificate are published there by law and are publicly searchable. This does not include your telephone number or email address.
• ECMK, our accreditation scheme, for quality assurance and audit purposes
• Service providers who help us operate, such as our energy assessment software provider, website form provider and email provider
• Our accountant, where relevant for tax and accounting records
• Anyone we are legally required to share it with, such as a regulator or law enforcement

Where you were referred to us by an estate agent, letting agent or landlord, we may share the completed certificate with them as the party instructing the work.

How long we keep it

We keep assessment records for as long as required by our accreditation scheme and by law. Financial records are kept for six years as required by HMRC. Enquiries that do not result in a booking are deleted within 12 months. Certificates lodged on the national register are retained there under the register's own rules and are valid for 10 years.

How we protect it

We use appropriate technical and organisational measures to keep your information secure, including password-protected devices and accounts, encrypted connections on our website, and limiting access to those who need it. No method of transmission over the internet is completely secure, but we take reasonable steps to protect your data.

Cookies and analytics

Our website uses Google tracking tags to measure the performance of our advertising, for example to understand how many people who click one of our adverts go on to make an enquiry. This may set cookies on your device. You can control or block cookies through your browser settings. We do not use cookies to identify you personally.

Advertising

We advertise on Google. If you submit your details through an advertisement lead form, that information is passed to us by Google and handled in line with this policy. Google's own handling of your data is covered by Google's Privacy Policy.

Your rights

Under UK GDPR you have the right to:

• Ask for a copy of the personal information we hold about you
• Ask us to correct information that is inaccurate or incomplete
• Ask us to delete your information, where we are not legally required to keep it
• Ask us to restrict how we use your information
• Object to us processing your information
• Ask us to transfer your information to another provider
• Withdraw consent, where we relied on consent

To exercise any of these rights, contact us using the details above. We will respond within one month. Please note that we cannot remove a certificate from the national EPC register, as its publication is a legal requirement.

Complaints

If you are unhappy with how we have handled your personal information, please contact us first so we can try to put it right. You also have the right to complain to the Information Commissioner's Office (ICO), the UK's data protection regulator, at ico.org.uk or on 0303 123 1113.

Changes to this policy

We may update this policy from time to time. Any changes will be posted on this page with a revised date at the top.
